Terms of Service

The service

StratDaily uses business information and local context to identify marketing opportunities and prepare recommended timing, offers, copy, and visual assets. Available features, delivery methods, and integrations may change as the product develops.

StratDaily provides marketing recommendations and prepared assets. You remain responsible for reviewing, approving, and lawfully using any campaign, claim, offer, message, or image before sharing it with customers.

Eligibility and account information

You must be at least 18 and able to enter a binding agreement. You agree to provide accurate information, keep your business and delivery settings current, safeguard private opportunity and portal links, and promptly notify us of suspected unauthorized access.

Introductory access and subscriptions

Eligible new businesses receive introductory access to one private Week Ahead Briefing and may receive up to three qualifying delivered marketing opportunities within their first 30 days, with no credit card required. The briefing is separate and does not use an opportunity credit. An opportunity counts under the displayed offer rules. Introductory access is not a promise that three qualifying opportunities will occur.

If you choose to continue, the current subscription price and billing interval will be shown before checkout. Subscriptions renew automatically until canceled. You can manage or cancel a paid subscription through the billing portal. Unless required by law, payments already made are non-refundable.

Text messages and email

Email delivery may be part of the service. SMS is optional and requires separate consent. If you opt in, you agree to receive recurring automated StratDaily marketing alerts, including marketing opportunities and Week Ahead briefings, at the number provided. Frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase.

You confirm that you control the number and email address you provide and will update us if either changes. Carriers are not liable for delayed or undelivered messages.

Your business content

You retain ownership of logos, photos, menus, brand materials, and other content you submit. You grant StratDaily a non-exclusive license to host, process, adapt, and display that content as needed to provide and improve the service for your business. You represent that you have the rights needed to provide and use the content.

Acceptable use

You may not use StratDaily to:

• break the law or infringe another person’s rights;
• make deceptive, discriminatory, or unsupported claims;
• send messages without the consent required by applicable law;
• probe, disrupt, scrape, reverse engineer, or bypass service security;
• share private customer links outside the intended business team; or
• upload malicious code or content you do not have permission to use.

Third-party services

StratDaily may rely on or link to third-party services such as payment, messaging, hosting, analytics, or marketing platforms. Their terms and privacy practices govern your direct use of those services. We are not responsible for third-party services outside our control.

No guaranteed results

Local conditions and marketing performance are uncertain. We do not guarantee traffic, sales, reservations, engagement, revenue, availability of a particular opportunity, uninterrupted service, or that every recommendation will be accurate or suitable. You are responsible for offer economics, inventory, staffing, disclosures, and compliance with platform and advertising rules.

Suspension and termination

You may stop future opportunities or cancel a paid subscription through the available account tools. We may suspend or terminate access when reasonably necessary to protect StratDaily, customers, or third parties; respond to legal requirements; address nonpayment; or enforce these Terms. Provisions that by their nature should survive will continue after termination.

Disclaimers and liability

To the fullest extent allowed by law, StratDaily is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

To the fullest extent allowed by law, StratDaily will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, or goodwill. Our total liability arising from the service will not exceed the amount you paid to StratDaily during the three months before the event giving rise to the claim.

Changes, governing law, and contact

We may update these Terms as the service changes. Revised Terms will be posted here with a new effective date. Continued use after an update means you accept the revised Terms.

Tennessee law governs these Terms, without regard to conflict-of-law rules. Any dispute must be brought in a state or federal court with jurisdiction in Davidson County, Tennessee, unless applicable law requires otherwise.
